Dubai, UAE – The Ministry of Finance (MoF) has released two new ministerial decisions that redefine how corporate tax rules apply to companies operating in UAE free zones. These updates replace an earlier decision from 2023 and provide clearer guidelines for businesses seeking to benefit from free zone tax incentives.

Key Updates to Free Zone Corporate Tax Rules

  • Broader range of qualifying commodities: In addition to metals, minerals, energy, and agricultural products, qualifying commodity trading now covers industrial chemicals, environmental commodities, and by-products of qualifying commodities.
  • Trading beyond raw form: Businesses are no longer restricted to trading commodities only in their raw state. As long as a recognized market price exists, they can trade processed forms as well.
  • Treasury and financing services clarified: The MoF confirmed that treasury and financing activities can be carried out for related parties or for the company’s own account, giving firms more operational flexibility.
  • Distribution rules updated: Companies distributing goods from designated free zones can now include transactions with public benefit entities without impacting compliance thresholds.

Recognized Price Reporting Agencies

Alongside these changes, the Ministry also announced a list of approved price reporting agencies. Businesses are required to use these agencies when referencing quoted commodity prices, ensuring consistency and transparency in compliance.
